Terms of Service

These Terms of Service govern your access to and use of the Wizani service. By creating an account or using Wizani, you agree to these terms. If you do not agree, do not use the service.

1. Acceptance

By signing up for or using Wizani, you confirm that you have read, understood, and agree to be bound by these Terms of Service and by our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use Wizani, or 13+ with the consent and supervision of a parent or guardian where your jurisdiction permits. You confirm that you have the legal capacity to enter into binding agreements.

3. Your account

You may have one account at a time. You must provide accurate information when signing up and keep it up to date. You are responsible for all activity that occurs under your account, including for keeping your credentials secure. Notify us immediately at info@wizani.ai if you believe your account has been compromised.

4. Acceptable use

You agree not to:

• Use Wizani for any illegal purpose or in violation of any law that applies to you.
• Use Wizani to harass, defame, threaten, dox, or otherwise target individuals.
• Reverse-engineer, scrape, or systematically extract data from Wizani to build or train a competing product.
• Resell, sublicense, or commercially redistribute Wizani reports, certificates, or outputs as standalone products.
• Misrepresent Wizani reports as anything other than AI-summarised analysis of publicly-available data.
• Use Wizani in ways that violate the terms of service of the third-party platforms we analyse.
• Interfere with the operation, security, or integrity of the Wizani service.

5. Credits and payment

• Wizani uses a credit-based pricing model. Credits are the service's internal unit of consumption.
• Credits are non-transferable and have no cash value outside the Wizani service.
• Top-up purchases are non-refundable except where a refund is required by applicable law.
• Credits do not expire while your account remains active.
• We may change our prices, credit costs, or top-up packages at any time without prior notice. Existing credit balances already purchased are not affected by price changes.
• Failed runs and product errors caused by Wizani may be refunded as credits at our discretion.

6. AI-generated content and accuracy

Wizani reports use AI to analyse publicly-available data from third-party social media platforms. By using the service, you understand and accept that:

• We do not guarantee the accuracy, completeness, or currency of any report.
• AI summarisation can contain errors. We apply mitigations but cannot eliminate this risk.
• Third-party platforms can change their content, visibility, or APIs at any time; data fetched at the time of a report may not reflect later changes.
• Reports are descriptive summaries of public data. They are not financial, legal, medical, business, or professional advice.
• You are responsible for verifying anything you intend to act on or publish.

7. Your use of Wizani outputs (user responsibility)

This section is important. Please read it carefully.

• You are solely responsible for how you use, share, publish, market, promote, distribute, or otherwise act on any Wizani output — including reports, dossiers, certificates, social cards, exported PDFs, and screenshots.
• If you publish, post, market, or otherwise make available a Wizani output (for example on social media, in a presentation, in marketing collateral, in a pitch deck, in an article, or to any third party), you assume all legal and commercial risk arising from that act — including but not limited to claims of defamation, intellectual property infringement, privacy violation, unfair competition, regulatory complaint, or any third-party platform terms-of-service violation.
• Wizani provides AI-summarised analysis of publicly-available data. We do not endorse, authorise, or direct any specific public or commercial use of our outputs.
• You must apply your own judgment and, where appropriate, seek your own legal advice before publishing, marketing, or relying on a Wizani output in a public, commercial, or legal context.
• To the maximum extent permitted by law, Wizani disclaims all liability for downstream consequences of your use of our outputs.

8. Third-party platforms

Wizani reads publicly-available data from third-party social media platforms. We are not affiliated with, endorsed by, or sponsored by those platforms. The content remains the property of its respective owners, and the use of those platforms remains subject to their own terms.

9. Intellectual property

• Wizani: The Wizani service, brand, software, templates, design system, and aggregate analytics are owned by us and protected by intellectual property laws.
• Your inputs: The queries, handles, focus questions, and other content you submit remain yours. You grant Wizani a worldwide, non-exclusive, royalty-free licence to use, process, and analyse your inputs for the purpose of operating the service.
• Reports we generate for you: You may use Wizani-generated reports for your own internal and commercial purposes, subject to these Terms — in particular section 7 above. Wizani retains the right to use de-identified or aggregate signals from your usage to improve the service.
• No resale: You may not resell, sublicense, or commercially redistribute Wizani reports or outputs as a standalone product or service.

10. Termination

You may close your account at any time by contacting info@wizani.ai. We may suspend or terminate your access to Wizani at any time, with or without notice, if you violate these Terms or if your account activity creates legal, security, or operational risk. Unused credits at the time of voluntary closure or termination for cause are not refundable, except where a refund is required by applicable law.

11. Disclaimers

Wizani is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not guarantee that the service will be available at all times or that reports will be free from errors.

12. Limitation of liability

To the maximum extent permitted by applicable law, Wizani's total aggregate liability for any claim arising from or related to your use of the service is limited to the amount you actually paid Wizani in credits in the twelve (12) months preceding the event giving rise to the claim. In no event will Wizani be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenues, lost goodwill, or business interruption, even if advised of the possibility of such damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless Wizani, its owners, officers, employees, and partners from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) your use, publication, or distribution of any Wizani output.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or your use of Wizani will be subject to the exclusive jurisdiction of the courts of Kenya.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or a notice on the service. The "Last updated" date at the top of this page reflects the latest revision. Your continued use of Wizani after an update means you accept the updated Terms.
